They define the working relationship: what Montenegro Listings may do, what must be commissioned separately, which obligations the client has and which decisions remain outside the control of ekosphere doo.\r\n    <\/p>\r\n\r\n    <div class=\"ek-services-grid ek-grid-cards--4\">\r\n\r\n      <article class=\"ek-card\">\r\n        <h3>Scope and Role<\/h3>\r\n        <p>\r\n          Depending on the agreement, ekosphere doo may provide information, coordination, inquiry sorting, viewing preparation, property pre-checks or specialist routing.\r\n        <\/p>\r\n        <ul class=\"ek-list ek-list--success\">\r\n          <li><strong>No automatic success duty:<\/strong> unless expressly agreed.<\/li>\r\n          <li><strong>Separate roles:<\/strong> own services, brokerage and third-party services remain distinct.<\/li>\r\n          <li><strong>Decisive scope:<\/strong> confirmed offer or written agreement.<\/li>\r\n        <\/ul>\r\n      <\/article>\r\n\r\n      <article class=\"ek-card\">\r\n        <h3>Prices and Payment<\/h3>\r\n        <p>\r\n          Prices, commissions, service fees and additional work depend on the published price logic, specific offer or confirmed individual agreement.\r\n        <\/p>\r\n        <ul class=\"ek-list ek-list--success\">\r\n          <li><strong>Additional work:<\/strong> requires separate approval or may be billed separately.<\/li>\r\n          <li><strong>Due date:<\/strong> according to offer or invoice, otherwise within 7 calendar days.<\/li>\r\n          <li><strong>Partial work:<\/strong> already performed work may be billed.<\/li>\r\n        <\/ul>\r\n      <\/article>\r\n\r\n      <article class=\"ek-card\">\r\n        <h3>Client Cooperation<\/h3>\r\n        <p>\r\n          Real estate-related work depends on complete information, documents, authorizations, appointments, capital clarity and timely decisions from the client.\r\n        <\/p>\r\n        <ul class=\"ek-list ek-list--success\">\r\n          <li><strong>Required:<\/strong> complete information, documents and decisions.<\/li>\r\n          <li><strong>Delays:<\/strong> missing cooperation may delay or prevent performance.<\/li>\r\n          <li><strong>Third parties:<\/strong> authority, bank, notary and cadastral decisions are not guaranteed.<\/li>\r\n        <\/ul>\r\n      <\/article>\r\n\r\n      <article class=\"ek-card\">\r\n        <h3>Liability and Boundaries<\/h3>\r\n        <p>\r\n          Liability depends on the service type, agreed scope, own fault and mandatory law. General Provisions and Scope<\/strong><\/p>\r\n      <p>\r\n        These Terms and Conditions apply to services connected with <strong>Montenegro Listings<\/strong>, operated by <strong>ekosphere doo<\/strong>, Bulevar Teuta bb, 85360 Ulcinj, Montenegro, PIB: 0317 1868, REG: 5081 9609, PDV: 82 \/ 31-02022-6.\r\n      <\/p>\r\n\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>They apply to website use, real estate inquiries, listing selection, property orientation, viewing coordination, property pre-checks, document organization, purchase coordination and related local support.<\/li>\r\n        <li>Different or conflicting client terms apply only if expressly confirmed by ekosphere doo in text form.<\/li>\r\n        <li>Mandatory statutory provisions, especially consumer protection rules where applicable, remain unaffected.<\/li>\r\n        <li>If a clause applies only to entrepreneurs or consumers, it must be interpreted within the legally permissible narrower scope.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-2\"><strong>2. Contracting Parties, Consumers, Entrepreneurs and Text Form<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li><strong>Consumer<\/strong> means a natural person acting primarily outside their trade, business or independent professional activity.<\/li>\r\n        <li><strong>Entrepreneur<\/strong> means a natural or legal person or legally capable partnership acting in the course of commercial or independent professional activity.<\/li>\r\n        <li><strong>Text form<\/strong> includes e-mail, confirmed messenger communication, electronically signed documents or other traceable electronic communication, unless stricter legal form requirements apply.<\/li>\r\n        <li>Changes to scope, price, deadlines, responsibilities or third-party involvement require at least text form.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-3\"><strong>3. Subject Matter and Service Description<\/strong><\/p>\r\n      <p>\r\n        Depending on the agreement, Montenegro Listings may include the following services:\r\n      <\/p>\r\n\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>Initial classification of purchase interest, budget, property type, intended use and timeframe.<\/li>\r\n        <li>Pre-selection of apartments, houses, villas, land, commercial units, rentals, new developments or investment-related property opportunities in Montenegro.<\/li>\r\n        <li>Organization of initial information, owner statements, seller information, property material and viewing appointments.<\/li>\r\n        <li>Coordination of property pre-checks, document collection, cadastral extracts, available property files and purchase preparation.<\/li>\r\n        <li>Coordination with lawyers, notaries, translators, tax advisors, banks, authorities, surveyors, engineers, architects, sellers, project developers or other third parties.<\/li>\r\n        <li>Assistance with purchase coordination, payment logic, handover preparation and organizational follow-up steps.<\/li>\r\n      <\/ul>\r\n\r\n      <p>\r\n        The exact scope, timeframe, service location, role of ekosphere doo and remuneration are determined by the individual agreement, written offer, confirmed booking or project arrangement.\r\n      <\/p>\r\n\r\n      <p>\r\n        Descriptions on websites, landing pages, PDFs, property cards, listings, presentations or social media are for orientation only. They do not replace a concrete mandate definition.\r\n      <\/p>\r\n\r\n      <p id=\"terms-4\"><strong>4. Role Separation: Own Services, Brokerage and Third-Party Services<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>ekosphere doo may provide services directly, broker, coordinate, structure, prepare or route matters to third parties.<\/li>\r\n        <li>Contact facilitation, appointment scheduling, document sorting or communication structuring does not automatically mean that ekosphere doo owes the third-party service itself.<\/li>\r\n        <li>Notaries, lawyers, certified translators, accountants, tax advisors, engineers, architects, banks, authorities, registries, cadastral offices, insurance providers, sellers, project developers and other external parties remain independent service providers unless expressly agreed otherwise.<\/li>\r\n        <li>ekosphere doo is not liable for content, duration, availability, decisions or errors of third parties unless ekosphere doo caused the issue by its own fault or expressly assumed a specific written guarantee.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-5\"><strong>5. Prices, Price Information and Decisive Price Basis<\/strong><\/p>\r\n      <p>\r\n        Published prices, price ranges, packages, commission structures or service descriptions on montenegro-listings.me apply in the version current at the time of inquiry unless a different offer has been confirmed in writing.\r\n      <\/p>\r\n\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>Prices may be displayed as fixed prices, starting prices, price ranges, package prices, commission logic or price on request.<\/li>\r\n        <li>The applicable service description or individually confirmed offer is decisive for the commissioned work.<\/li>\r\n        <li>If website information and an individual offer conflict, the confirmed individual offer prevails.<\/li>\r\n        <li>Brokerage, property pre-checks, viewing coordination, document organization and transaction support may follow different remuneration logic.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-6\"><strong>6. Remuneration, Additional Work and Change Requests<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>The commissioned service is remunerated, not a subjectively expected total outcome, unless an express success obligation has been agreed.<\/li>\r\n        <li>Additional work caused by new facts, additional people, additional properties, new documents, translations, rework, extra appointments, site visits, authority requests, bank questions or other extensions may be billed separately.<\/li>\r\n        <li>Change requests and service extensions may be approved in text form.<\/li>\r\n        <li>Started consultation, review, coordination or preparation units may be billed proportionally or according to the offer logic unless otherwise agreed.<\/li>\r\n        <li>Monthly services begin on the agreed start date; renewal applies only if regulated in the offer or confirmed agreement.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-7\"><strong>7. Due Date, Advance Payments and Default<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>Invoices are due on the date stated in the invoice or offer; if no specific rule applies, payment is due within 7 calendar days from the invoice date.<\/li>\r\n        <li>ekosphere doo may make services dependent on reasonable deposits, advance payments or partial payments.<\/li>\r\n        <li>Project-related implementation work may be suspended until payment is received.<\/li>\r\n        <li>In case of default, ekosphere doo may claim default interest, reminder costs and further default damages according to applicable law.<\/li>\r\n        <li>Set-off or retention rights exist only with undisputed or legally established claims, where legally permissible.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-8\"><strong>8. Appointments, Viewings, Site Visits and Cancellations<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>Booked calls, viewing appointments, document review slots, site visits and fixed coordination periods are reserved for the client.<\/li>\r\n        <li>If a confirmed appointment is postponed, cancelled or made impossible by the client at short notice, ekosphere doo may bill blocked time, preparation and third-party costs.<\/li>\r\n        <li>Unless otherwise agreed, cancellation is short notice if made less than 24 hours before remote appointments or less than 72 hours before site visits or property viewings.<\/li>\r\n        <li>Travel, preparation, organizational or third-party costs already incurred must be reimbursed where the client caused the cancellation or impossibility.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-9\"><strong>9. Website Use and Content<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>The website montenegro-listings.me may be used only for lawful purposes.<\/li>\r\n        <li>Texts, images, graphics, databases, concepts, reports, checklists, listing structures, property cards, presentations, roadmaps and software may be protected by copyright or related rights.<\/li>\r\n        <li>Any use beyond ordinary website access or contractually intended use requires prior permission in text form.<\/li>\r\n        <li>Internal documents, price sheets, dossiers, reports, property lists and contractual materials may not be disclosed to third parties, especially competitors, without permission unless legally required.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-10\"><strong>10. Real Estate Brokerage, Property Pre-Checks and Purchase Coordination<\/strong><\/p>\r\n      <p>\r\n        Brokerage of third-party properties, land plots or investment-related real estate opportunities may be subject to commission. The basis is the respective brokerage, mediation, agency or project agreement.\r\n      <\/p>\r\n\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>The specific commission, due date and billing logic are determined by the relevant agreement.<\/li>\r\n        <li>Property pre-checks, document review, viewing coordination or purchase structuring without a brokerage mandate are not automatically classic brokerage services and may be billed separately.<\/li>\r\n        <li>Additional services such as authority visits, registrations, insurance support, bank coordination, payment structure, renovation planning, legal routing or specialist advice are not automatically included in brokerage commission.<\/li>\r\n        <li>For properties from own project structures or special project arrangements, the respective project, object or fee conditions apply.<\/li>\r\n        <li>Brokerage services generally end with the contractually defined commission trigger; later support must be commissioned separately.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-11\"><strong>11. Documents, Cadastre, Notary and Purchase Files<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>ekosphere doo may collect, sort, forward, translate, coordinate or organize documents.<\/li>\r\n        <li>Legal assessment, notarial review, court evaluation, cadastral decision or binding authority information is provided by the competent authority or qualified professional.<\/li>\r\n        <li>Unless expressly guaranteed in text form, ekosphere doo does not guarantee the correctness of seller statements, cadastral records, building permits, usage claims, utility information, access information or third-party documents.<\/li>\r\n        <li>A purchase should be made only after the relevant documents, ownership situation, contractual structure, payment logic and notarial feasibility have been checked for the individual case.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-12\"><strong>12. Source of Funds, Payments and Banking Process<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>The client is responsible for the lawful origin, availability, transferability and use of their funds.<\/li>\r\n        <li>Banks, notaries, sellers, authorities or other parties may request proof of source of funds, identity, purpose of funds or beneficial ownership.<\/li>\r\n        <li>ekosphere doo may organize or explain payment logic but does not guarantee bank acceptance, account opening, payment release or regulatory assessment by third parties.<\/li>\r\n        <li>Cash, bank transfer, escrow, notarial account or other payment structures require individual review by the responsible professionals or institutions.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-13\"><strong>13. Residence, Tax, Use and Follow-Up Topics<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>A property purchase may trigger further topics such as residence, registration, tax, insurance, rental, property management, renovation or ongoing maintenance.<\/li>\r\n        <li>Such follow-up topics are not automatically included in a real estate inquiry, viewing coordination or purchase coordination.<\/li>\r\n        <li>They may be offered separately, coordinated separately or referred to qualified third parties.<\/li>\r\n        <li>Official decisions, tax assessments, residence decisions, banking decisions and permit outcomes are not guaranteed.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-14\"><strong>14. Client Cooperation Obligations<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>The client must provide required information, documents, evidence, authorizations, decisions and feedback in a timely, complete and correct manner.<\/li>\r\n        <li>The client must check drafts, checklists, overviews, offers, roadmaps, contract drafts or submission files for obvious errors where reasonable.<\/li>\r\n        <li>The client must promptly inform ekosphere doo about changes in budget, timeline, property target, funding availability, travel plans, contact details or legally relevant circumstances.<\/li>\r\n        <li>If necessary cooperation is not provided despite request, ekosphere doo may postpone deadlines, suspend services or terminate the agreement for good cause and bill work performed until then.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-15\"><strong>15. Distance Contracts, Service Start and Consumer Notice<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>If contracts are concluded remotely or outside business premises with consumers, mandatory consumer protection rules apply where applicable.<\/li>\r\n        <li>If ekosphere doo begins performance before expiry of statutory withdrawal periods at the consumer&rsquo;s request, express consent to early performance may be required.<\/li>\r\n        <li>Properly performed partial services, preliminary checks, reserved appointments, property pre-selections or individually prepared documents may be billed proportionally where legally permissible.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-16\"><strong>16. Complaints, Defect Notice and Approvals<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>Complaints regarding invoices, reports, review results, dossiers, appointment notes or work status must be made promptly in text form and must identify the specific issue.<\/li>\r\n        <li>General objections without identifying the defect or affected service component are insufficient.<\/li>\r\n        <li>Interim results, drafts or to-do structures are considered approved if the client confirms them or continues work based on them without clear objection within a reasonable period.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-17\"><strong>17. Liability<\/strong><\/p>\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>ekosphere doo is liable without limitation for intent and gross negligence and in cases of mandatory statutory liability.<\/li>\r\n        <li>In case of simple negligence, ekosphere doo is liable only for breach of essential contractual obligations; in such case liability is limited to foreseeable contract-typical damage.<\/li>\r\n        <li>No liability exists for decisions, processing times or errors of authorities, banks, notaries, courts, registries, cadastral offices, translators, insurance providers, sellers, project developers or other third parties unless ekosphere doo caused the issue by its own fault.<\/li>\r\n        <li>No liability exists for lost profit, indirect damage, consequential damage or unrealized economic advantages where legally permissible and no essential contractual duty is affected.<\/li>\r\n        <li>No liability exists where damage results from incorrect, incomplete, delayed or withheld information provided by the client.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-18\"><strong>18. Data Protection<\/strong><\/p>\r\n      <p>\r\n        Personal data is processed in accordance with applicable data protection rules. The Privacy Policy published on this website applies in addition.\r\n      <\/p>\r\n\r\n      <ul class=\"ek-list ek-list--success\">\r\n        <li>Data may be disclosed to authorities, registries, banks, notaries, translators, accountants, lawyers, project partners, sellers or other involved third parties where necessary for performance or where legally required.<\/li>\r\n        <li>The client is responsible for ensuring that they are entitled to transmit data of third parties, including family members, employees, co-owners, representatives or project participants.<\/li>\r\n      <\/ul>\r\n\r\n      <p id=\"terms-19\"><strong>19. Governing Law and Jurisdiction<\/strong><\/p>\r\n      <p>\r\n        For disputes arising from or in connection with contractual relationships, the place of jurisdiction is <strong>Ulcinj, Montenegro<\/strong>, where legally permissible. The substantive law of Montenegro applies, excluding conflict-of-law rules, unless mandatory protection rules provide otherwise.\r\n      <\/p>\r\n\r\n      <p id=\"terms-20\"><strong>20. PDV \/ VAT \/ Taxes<\/strong><\/p>\r\n      <p>\r\n        PDV means <em>Porez na dodatu vrijednost<\/em>, the Montenegrin value added tax. Unless expressly stated otherwise, prices and fees are net amounts plus applicable PDV, where legally required.\r\n      <\/p>\r\n\r\n      <p>\r\n        Tax effects of a transaction, acquisition, company structure, rental use, resale or international payment flow must be checked separately by qualified tax professionals. ekosphere doo does not guarantee tax results.\r\n      <\/p>\r\n\r\n      <p id=\"terms-21\"><strong>21.
